Welcome to LifeSpark Labs, Inc. ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our web and mobile applications, including any interactive, game-based, or AI-powered experiences (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
The Service is intended for individuals 18 years of age or older.
While the content and experiences offered through the Service are generally appropriate for a broad audience, the Service is not designed for or directed to individuals under 18, and we do not knowingly collect personal information from minors.
By accessing or using the Service, you represent and warrant that you are at least 18 years old.
If we become aware that an individual under 18 has created an account or is using the Service without an authorized exception, we may suspend or terminate the account and delete associated data.
We may, at our discretion, permit access to individuals under 18 through structured programs, educational partnerships, or parent-approved experiences subject to additional terms.
2. Account Registration
To access certain features, you may need to create an account. You agree to provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
3. Plans, Pricing, and Billing
Membership Plans
We may offer one or more paid plans, including but not limited to:
- Monthly subscriptions. Billed monthly. You may cancel at any time to avoid future charges. No refunds will be provided for the current billing period.
- Annual subscriptions. Billed annually. You may cancel at any time to avoid renewal charges. No refunds will be provided for the current annual period.
- Time-bound programs, sprints, or special access offerings. Offered for a fixed duration or defined experience with a clear start and end date. These offerings do not renew automatically. All fees are non-refundable, except as required by law or expressly stated at the time of purchase.
Refund Exception Policy
All payments are non-refundable, except in limited circumstances where the Service fails to provide core, advertised functionality as described at the time of purchase.
To request consideration for a refund:
- You must submit a written request within 7 calendar days of purchase.
- You must provide evidence that a specifically described feature was non-functional for the duration of your access.
- Features described as "examples," "exploratory," or "coming soon" are not considered core functionality.
Refund determinations are made at our sole discretion. No outcomes or benefits are guaranteed.
4. AI-Powered Features and Important Disclaimers
Some features use artificial intelligence to generate content, feedback, or guidance ("AI Outputs").
By using the Service, you acknowledge and agree that:
- AI Outputs are generated automatically and may not be reviewed by a human.
- AI Outputs are not professional advice, including career, psychological, educational, financial, or legal advice.
- You are solely responsible for how you interpret or act on any AI Output.
- We do not guarantee accuracy, relevance, or outcomes from AI Outputs.
Limitation of Use
You may not rely on AI Outputs for decisions that may affect your health, safety, finances, education, or legal status. The Service is provided for informational, educational, and experiential purposes only.
5. User Content and Conduct
You may contribute content ("User Content") such as responses, creative submissions, or journal entries. You retain ownership, but grant us a worldwide, royalty-free license to use, reproduce, display, and modify the User Content solely to operate and improve the Service.
You agree not to:
- Submit unlawful, harmful, discriminatory, or infringing content.
- Attempt to disrupt, reverse-engineer, or misuse the Service.
6. Intellectual Property
All materials on the Service, including software, game mechanics, designs, graphics, and content (excluding User Content), are owned by the Company or its licensors and are protected by intellectual property laws. Unauthorized use is prohibited. You may not use them without express written permission.
7. Third-Party Services
The Service may integrate third-party tools or services. We are not responsible for third-party content, security, or practices. Use of third-party services is at your own risk.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," with no warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or usefulness of the Service or its outputs, including AI-generated content.
9. Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, special, or consequential damages, including loss of data, opportunity, or revenue, arising out of or related to your use of the Service.
10. Arbitration and Dispute Resolution
All disputes will be resolved through binding arbitration, except for claims eligible for small claims court.
- Arbitration will be administered by the American Arbitration Association (AAA) under its rules.
- Arbitration will take place in San Diego, California, unless otherwise agreed.
- You waive the right to a jury trial and class actions.
- You may opt out of this clause by notifying us in writing within 30 days of accepting these Terms.
11. Termination
We may suspend or terminate your access at any time, with or without notice, for violation of these Terms or for operational or legal reasons.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
